Terms of Service

These Terms of Service ("Terms") govern your use of Outsquid, a cold email platform operated by [TBD: legal entity name], [TBD: registered address] ("Outsquid", "we", "us"). By creating an account or using Outsquid you agree to these Terms. If you use Outsquid on behalf of a company, you agree on its behalf and confirm you are authorised to do so.

1. Your account

  • You need an account to use Outsquid. Keep your login details secure; you are responsible for activity under your account.
  • Accounts belong to an organization. The organization's Owner manages its members, projects and billing.
  • You must give accurate information and keep it up to date.

2. Plans, billing and limits

  • Outsquid offers a free plan and paid plans. Each plan includes a number of emails per calendar month. When an organization reaches its monthly limit, further sends wait until the next month or until the plan is upgraded.
  • Paid plans are billed in advance, monthly or yearly, through our payment processor, Stripe. Plans renew automatically until cancelled.
  • You can cancel at any time; the plan stays active until the end of the paid period. Except where the law requires otherwise, payments are not refunded.
  • We may change prices with at least 30 days' notice before your next renewal.

3. Acceptable use

You must follow our Acceptable Use & Sending Policy. In short: only email people you have a lawful basis to contact, never buy lists, honour every opt-out, and don't send anything deceptive or harmful. You are responsible for the content you send and for complying with the laws that apply to your outreach (for example CAN-SPAM, GDPR, PECR and CASL).

4. Your data

  • You keep all rights to the data you put into Outsquid: your prospects, the emails you write, and the replies you receive ("Customer Data").
  • You give us permission to process Customer Data only to provide and improve the service for you, as described in our Privacy Policy and, where applicable, our Data Processing Agreement.
  • You can export your prospects at any time.

5. Connected mailboxes

When you connect a Gmail, Microsoft 365 or SMTP/IMAP mailbox, you authorise Outsquid to send email from it and read the replies to your campaigns on your behalf. You can disconnect a mailbox at any time from the app or from your Google or Microsoft account settings.

6. Deliverability

We pace sending and apply safeguards to protect your sender reputation, but we cannot guarantee that any email will be delivered or land in the inbox. Mailbox providers decide that on their own.

7. Suspension and termination

We may pause sending or suspend an account that breaks these Terms or the Acceptable Use Policy, puts other customers' deliverability at risk, or doesn't pay. Where reasonable we will tell you first and give you a chance to fix the problem. You may close your account at any time.

8. Disclaimers and liability

Outsquid is provided "as is". To the extent the law allows, we disclaim implied warranties, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses, such as lost profits or lost data.

9. Changes to these Terms

We may update these Terms. If a change is material we will notify account Owners by email at least 30 days before it takes effect. Continuing to use Outsquid after that means you accept the new Terms.
